Agreement to Terms

These Terms of Service (“Terms”) govern your use of the websites and services operated by Pacific Dream Photography Inc., including services provided under the Pacific Dream Photography, Blinnk Photography, and Coral Photography brands (collectively “we,” “us,” or “our”).

By accessing our websites or booking our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

  1. Photography Services

We provide professional photography session services at resort and hotel locations across Hawaii, including Maui, Oahu, the Big Island, and Kauai. The specific services, session duration, and deliverables for each booking are as described at the time of booking.

All sessions are subject to availability and confirmed only upon receipt of payment or deposit as required. We reserve the right to assign any qualified photographer from our team to your session.

  1. Bookings and Payment

Bookings may be made through our website, QR codes at partner hotel locations, or by contacting us directly. A booking is confirmed when you receive a written confirmation from us via email or SMS.

Payment is due at the time of booking or as otherwise specified. We accept major credit cards and other payment methods as indicated at checkout. All prices are in US dollars and subject to applicable taxes.

For sessions requiring a deposit, the remaining balance is due as specified in your booking confirmation.

  1. Cancellations and Rescheduling

We understand that plans change. Our cancellation and rescheduling policy is as follows:

Cancellations made more than 48 hours before the scheduled session may be eligible for a full refund or rescheduling at no charge, depending on the service package
Cancellations made within 48 hours of the scheduled session may be subject to a cancellation fee
No-shows are non-refundable
We reserve the right to cancel or reschedule sessions due to severe weather, safety concerns, or other circumstances beyond our control. In such cases, a full refund or complimentary reschedule will be offered

  1. Photo Delivery and Licensing

Edited photographs will be delivered via our online gallery platform within the timeframe specified at the time of booking, typically within 5 to 14 business days. You will receive a link to access and download your gallery.

Galleries are available for a limited time as specified in your delivery notification. We are not responsible for photographs not downloaded before gallery expiration.

Upon full payment, you receive a personal use license for your photographs. This license permits you to print, share, and display your photographs for personal non-commercial purposes. Commercial use requires a separate written agreement.

We retain the copyright to all photographs and reserve the right to use images for our portfolio, website, social media, and marketing materials unless you notify us otherwise in writing prior to your session.

  1. Client Responsibilities

To ensure the best possible experience, clients agree to:

Arrive on time for scheduled sessions. Late arrivals may result in a shortened session without a reduction in price
Follow reasonable direction from the photographer during the session
Comply with any rules or regulations at the session location, including resort or hotel guidelines
Notify us in advance of any special needs, accessibility requirements, or circumstances that may affect the session

  1. Limitation of Liability

To the fullest extent permitted by law, Pacific Dream Photography Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or websites.

Our total liability for any claim arising out of or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

We are not liable for circumstances beyond our reasonable control, including but not limited to weather conditions, natural disasters, or venue restrictions that affect our ability to provide services.

  1. Intellectual Property

All content on our websites, including text, graphics, logos, images, and software, is the property of Pacific Dream Photography Inc. and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

  1. Website Use

You agree to use our websites only for lawful purposes and in a manner that does not infringe the rights of others. You may not use our websites to transmit any harmful, offensive, or unauthorized content, or to attempt to gain unauthorized access to any systems.

We reserve the right to modify, suspend, or discontinue our websites at any time without notice.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maui County, Hawaii.

  1. Changes to These Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on our websites with a revised effective date. Your continued use of our services following any changes constitutes your acceptance of the updated Terms.
